and</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.1.B\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.1.B\" daya-type=\"ext\"></span> <span id=\"18\">(b)</span> </span> <span id=\"2950\">the seat belt must be properly adjusted and securely fastened.</span> </li> </ul> </div> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.2\"></div> <div class=\"subreg\"> <span class=\"designum\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.2\" daya-type=\"ext\"></span> <span id=\"34\">(2)\u2003</span> </span> <span id=\"2951\">A person 8 years or and over must not be seated as a passenger in a motor vehicle that is in motion in a seat which is not fitted with a seat belt unless\u2014</span> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.2.A\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.2.A\" daya-type=\"ext\"></span> <span id=\"18\">(a)</span> </span> <span id=\"2952\">each seat for which a seat belt is provided is occupied by another person; or</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.2.B\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.2.B\" daya-type=\"ext\"></span> <span id=\"18\">(b)</span> </span> <span id=\"2953\">the person is seated in a position behind the front seat of the vehicle and there is no available rear seating position fitted with a seat belt.</span> </li> </ul> </div> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.3\"></div> <div class=\"subreg\"> <span class=\"designum\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.3\" daya-type=\"ext\"></span> <span id=\"34\">(3)\u2003</span> </span> <span id=\"2954\"> <a class=\"external\" href=\"subreg_LOF.CAP176.TTRFJ00.REG27.1.htm\"> <span id=\"33\">Subregulations (1)</span> </a> and <a class=\"external\" href=\"subreg_LOF.CAP176.TTRFJ00.REG27.2.htm\"> <span id=\"33\">(2)</span> </a> do not apply to\u2014</span> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.3.A\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.3.A\" daya-type=\"ext\"></span> <span id=\"18\">(a)</span> </span> <span id=\"2955\">a person driving a motor vehicle backwards; or</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.3.B\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.3.B\" daya-type=\"ext\"></span> <span id=\"18\">(b)</span> </span> <span id=\"2956\">a person carrying a certificate issued by the Authority certifying that <a class=\"external\" href=\"subreg_LOF.CAP176.TTRFJ00.REG27.1.htm\"> <span id=\"33\">subregulation (1)</span> </a> does not apply to the person because\u2014</span> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.3.B.I\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.3.B.I\" daya-type=\"ext\"></span> <span id=\"18\">(i)</span> </span> <span id=\"2957\">the person is exempted by the Authority for reasons and conditions stated in the certificate; or</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.3.B.II\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.3.B.II\" daya-type=\"ext\"></span> <span id=\"18\">(ii)</span> </span> <span id=\"2958\">the Authority is satisfied, on a certificate of a registered medical practitioner, that because of medical unfitness or physical disability it is impracticable, undesirable or inexpedient that that person wears a seat belt.</span> </li> </ul> </li> </ul> </div> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.4\"></div> <div class=\"subreg\"> <span class=\"designum\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.4\" daya-type=\"ext\"></span> <span id=\"34\">(4)\u2003</span> </span> <span id=\"2959\">It is a defence for the driver of a taxi to establish that he or she had reasonable cause to believe that he or she was at risk of physical injury from a passenger and that complying with this regulation may have contributed to the risk.</span> </div> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.5\"></div> <div class=\"subreg\"> <span class=\"designum\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.5\" daya-type=\"ext\"></span> <span id=\"34\">(5)\u2003</span> </span> <span id=\"2960\">The following persons are exempted from wearing seat belts\u2014</span> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.5.A\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.5.A\" daya-type=\"ext\"></span> <span id=\"18\">(a)</span> </span> <span id=\"2961\">any person who has been issued with a certificate from a registered medical practitioner stating that the wearing of a seat belt by him or her is impracticable or undesirable for medical reasons;</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.5.B\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.5.B\" daya-type=\"ext\"></span> <span id=\"18\">(b)</span> </span> <span id=\"2962\">the driver of any vehicle operating as a taxi;</span> </li> </ul> <ul type=\"none\"> <li> <div class=\"hiddendiv\" data-value=\"LOF.CAP176.SGM_LOF.CAP176.TTRFJ00.REG27.5.C\"></div> <span class=\"lilabel\"> <span class=\"hidden\" data-refpt_id=\"LOF.CAP176.TTRFJ00.REG27.5.C\" daya-type=\"ext\"></span> <span id=\"18\">(c)</span> </span> <span id=\"2963\">any person who is in engaged in work which requires him or her to continuously stop, alight from and re-enter any motor vehicle at frequent intervals and does not, while engaged, driving or travelling in the vehicle at a speed of 35 kilometres per hour.</span> </li> </ul> <div class=\"histnote\"> <p> <span>[subreg (5) subst LN 51 of 2002 reg 10, 6 September 2002]</span> </p> </div> </div> </section>"}
