(1) If masters of 2 or more vessels wish to use a wharf at the same time, the port management company has the power to decide the order of priority.
(2) Without prejudice to subregulation (3), the order of priority is—
  • (a)passenger vessels (being foreign registered vessels designed and used primarily for the carriage of passengers for reward);
  • (b)roll on/roll off vessels;
  • (c)container vessels;
  • (d)other cargo vessels (not liquid tankers or dry bulk vessels);
  • (e)liquid bulk tankers;
  • (f)dry bulk tankers;
  • (g)warships or government vessels of any flag state; and
  • (h)other vessels.
(3) If the port management company considers it appropriate, it may vary the order of priority having regard to—
  • (a)safety to the port and vessel involved;
  • (b)the need to handle dangerous or hazardous cargoes in a safe and fast manner;
  • (c)efficiency of the port;
  • (d)efficient operation of the port;
  • (e)efficient operation of all or any vessel involved; and
  • (f)any medical reasons relating to any person on board a vessel.
(4) If 2 vessels are of equal priority, the Port Management Company may give priority to the vessel already berthed.
(5) If 2 vessels of equal priority are yet to berth, the Port Management Company may give priority to the vessel that arrived in the stream first.
